WINS-Radio Newark, New Jersey A Garden State Parkway toll taker who was fired after shooting paintballs at a van during a road rage incident on the highway is getting his job back.
The state Supreme Court Monday overturned a lower court, which upheld Jason Glassey's firing.
An arbitrator had ruled that Glassey should be reinstated after an eleven-month unpaid suspension.
The justices said courts can vacate an arbitration decision if the award, not the conduct, violates a public policy. The court said the action ordered by the arbitrator did not "contravene a clear mandate of public policy.''
Glassey was working at the Cape May toll plaza when the incident happened in 2004. At the time, his father was vice chairman of the South Jersey Transportation Authority, which operates the Atlantic City Expressway.
