It may be hard to tell by looking at some of the video, but police say a suspected drunk driver was almost five times the legal blood alcohol limit. Even with a blood alcohol level of .39, 51-year-old Delano Vigil was still able to do a little walking and talking with officers. State police found Vigil underneath his car near Chimayo late Monday afternoon. Police say he was using a shoe string to tie down the hood. Police suspect he may have hit something while driving. Dash cam video shows the suspected drunk driver was able to stand up straight, but not pass a field sobriety test. At one point during the stop, Vigil told police he had nothing to drink—but later changed his story, says Lt. Eric Garcia of the New Mexico State Police Department. “He clearly indicated, he said he didn't have any liquor in the beginning. And then he said ‘That’s not true," Garcia said. Police say Vigil has been arrested five times in New Mexico for DWI and at least 16 times in other states. At the time of his latest stop, Vigil had a revoked license and three warrants out for his arrest.
State police say a Mora County man arrested for his 22nd drunken driving offense had a blood-alcohol level almost five times higher than New Mexico's legal limit. Delano T. Vigil of Guadalupita, N.M., was arrested Monday near Espanola. A blood-alcohol analysis showed a content level of .393 percent. New Mexico's limit for presumed intoxication is .08 percent. State police say records showed Vigil has been arrested five times in New Mexico and at least 16 times elsewhere. Police say Vigil pulled his car over along Highway 76 around 5 p.m. and was using a shoe string to tie down his hood. Police think Vigil had crashed into something before pulling over. State police said the 51-year-old man was so drunk, he had to be taken by ambulance to Christus St. Vincent Hospital in Santa Fe. Linda Atkinson of the DWI Resource Center says the amount of alcohol in Vigil's blood stream could kill most people. "Anybody that is not a seasoned drinker cannot handle that. That's alcohol poisoning," she said. Vigil had three warrants out for his arrest in San Miguel, Bernalillo and Sandoval Counties which are all DWI related. Atkinson says Vigil needs to be under close watch. "We need to really flag him as a danger to the community, if he's ever out again he shouldn't be able to register a vehicle again," she said. Vigil, who faces a felony DWI charge, was booked into the Santa Fe County jail.
