CHICAGO SUN-TIMES WAUKEGAN, ILLINOIS A Waukegan man convicted of spitting into a police officer's mouth has been sentenced to 10 years in prison. Lacy L. Gilmore was sentenced last week, after the officer testified that Gilmore had spat a large amount of saliva into his mouth during an April arrest. Gilmore, 36, was arrested by Waukegan police on April 19, after he fought with his ex-girlfriend. When officers were putting him in the back seat of their squad car, Gilmore spat into the mouth and on the face of Waukegan officer Joshua Amann. The officer was checked out afterward at a hospital, where he was given shots but did not test positive for any communicable disease. Though aggravated battery is only a Class 2 felony, Lake County Associate Judge George Bridges -- a former Waukegan police chief -- had discretion to sentence Gilmore by tougher Class X guidelines because he had previous convictions for burglary.
